Heard learned counsel for the Parties.

It is brought to the notice of this Court that two out of total three land owners died. All the three branches through the surviving members taking support of the respective legal heir certificate have approached the Tahasildar, Khordha, vide Annexure-6 for correction of the mutation record. The Petitioners though attempted to satisfy their case for such relief and this Court though finds, there has been documents to support the case of the Petitioners, however since the claim of the Petitioners is pending before the Tahasildar, Khorda, vide Annexure-6, the Tahasildar, Khorda is directed to take a lawful decision on the basis of application and supporting materials considering the requirement for fresh preparation of Record of Right. For the remand of the matter to the Tahasildar, the objection

// 2 // raised by Mr. Sahoo is kept open to be also considered by the Tahasildar. Entire exercise be over within six weeks of service of copy of order.
