This matter is taken up through hybrid mode.

The Petitioners in this CMP seek to assail the order dated 9th December, 2017 passed by learned Civil Judge (Junior Division), Salipur in C.S. No. 247 of 2017, whereby he allowed the petition for compromise filed under Order XXXIII Rule 3 C.P.C. in the National Level Lok Adalat.

In course of hearing, Mr. Behuria, learned counsel for the Petitioners submits that interest of justice will be best served, if the Petitioners file an application for recall of the said order explaining the reasons thereof before the concerned court and prays for withdrawal of the CMP.

In view of such submission, this CMP is disposed of as withdrawn with an observation that if such an application is filed for recall of the impugned order before the concerned court, the same may be considered in accordance with law expeditiously. Urgent certified copy of this order be granted on proper application.
