IN THE HIGH COURT OF ORISSA AT CUTTACK

W.P.(C) No. 15555 of 2022 Sangram Keshari Jena .....

Petitioner Mr. K.C. Pradhan, Advocate Vs.

State of Odisha and others .....

Opposite Parties Mr. S. Jena, SC, S&ME Deptt

CORAM:

DR. JUSTICE B.R. SARANGI

ORDER

07.12.2022 Order No.

01.

This matter is taken up through hybrid mode.

2.

Heard learned counsel for the parties 3.

The petitioner has filed this writ petition seeking to quash the order dated 02.03.2022 under Annexure-7, whereby his prayer for posting in Jajpur district was rejected on the ground that though he had applied under SEBC category and selected under UR category, but other two candidates have been selected under SEBC category and posted against the vacancy of SEBC category in Jajpur District as per their position in SEBC select list.

4.

Mr. Jena, learned Standing Counsel for School & Mass Education Department produced the instruction received from the opposite party no.2, wherein at paragraph-8, it has been stated as follows:- "That, the selected candidates uploaded their district choices in order of preference and the allocation were made by a computer based online counseling programme, which was based on the basis of aforesaid logic. The petitioner, who was selected under UR category, had given his districts choices and Nabarangpur was one of his District choices."

5.

Since the petitioner had already exercised his choice and Nabarangpur was one of his district choices, this Court does not find any error in the order impugned. However, since the petitioner has exercised his option for Nabarangpur district, the authority shall consider the same and pass appropriate order in accordance with law. 6.

The writ petition is accordingly disposed of. Arun (DR. B.R. SARANGI, J.)
