This matter is taken up through Hybrid Arrangement (Virtual / Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

Learned counsel for the Petitioner submits that, the Petitioner is in custody since 12.04.2021 in connection with present case, i.e. 2(a)C.C. Case No.26 of 2021 pending in the court of learned Sessions Judge-cum-Special Judge, Ganjam, Berhampur. He further submits that despite the Petitioner being detained in judicial custody since more than one year, trial has not yet commenced in the case. In such view of the matter, learned counsel for the Petitioner seeks for a direction to the learned court below to expedite the trial and conclude the same preferably within four months hence. 4.

In such view of the matter, the learned counsel for the Petitioner does not want to press this bail application at this juncture, seeking liberty for the Petitioner to move his bail application afresh,

// 2 // if the trial is not concluded within a time to be stipulated by this Court.

Considering such submission, the learned trial court is directed to expedite and conclude the trial of the aforesaid case as expeditiously as possible, preferably within four months from today. In the event, trial is not concluded within the aforesaid stipulated period, the Petitioner is at liberty to move his bail application afresh, and the same shall be considered and disposed of by the learned trial court on its own merit in accordance with law. 6.

The BLAPL is disposed of accordingly.
