This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offences punishable under Sections 420/406/120-B, I.P.C.

It is submitted by learned counsel for the Petitioner that one Jyoti Mohapatra is the principal accused in this case. Further the seizure list attached to the bail application reveals that money receipts have been issued by said Jyoti Mohapatra. 5.

Considering the nature of allegation, gravity of the offence and the facts of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is observed that, in the event the Petitioner surrenders before the learned J.M.F.C.,(R), Balasore in

// 2 // C.T. Case No.2262 of 2017 corresponding to Khantapada P.S. Case No.431 of 2017 within a period of three weeks from today, the Petitioner shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper. 6.

The ABLAPL is disposed of accordingly.
