This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail, involving offences punishable under Sections 498-A/323/313/307/294/506/34, I.P.C. & Section 4 of the D.P. Act.

Learned counsel for the Petitioners submits that the allegation of assault is against the husband of the victim. So far as the present petitioners are concerned, they are father-in-law and mother-in-law of the Informant-victim and there is no specific allegation of any assault have been made by the present Petitioners. Further, the present case arises out of a complaint case.

Considering the nature of allegation, gravity of the offence and the facts of the case, I am not inclined to grant anticipatory bail to the Petitioners. However, it is observed that, in the event of arrest, the Petitioners shall be released on bail by the Arresting Officer in Kalimela P.S. Case No.147 of 2022 corresponding to G.R. Case No.289 of 2022 pending in the court of learned J.M.F.C., Motu, on such terms and conditions as deemed just and proper in the facts and circumstances of the present case.

The ABLAPL is disposed of accordingly.
