Heard Mr. R.K. Sahoo, learned counsel for the Petitioner and Mr. Mohanty, learned counsel representing National Highway Authorities.

On oral prayer, Mr. Sahoo is permitted to appropriately describe Opposite Party Nos.3 & 4 to implead the Collector & Arbitrator, Puri as Opposite Party No.4.

According to Mr. Sahoo, though being dissatisfied with the award amount under Annexure-4 in connection with Land Acquisition Case No. 2 (34/1)/ 2021, the petitioner has approached the Collector & Arbitrator, Puri (Opposite Party No.4) under Sub-Section 5 of Section 3G of the National Highways Act, 1956 for re-determination of the amount and though the same has been registered as ARB Misc. Case No. 64 of 2022, however till date the same has not been disposed of.

// 2 // Accordingly, he prays that a direction be issued to the Opposite Party No.4 to dispose of the same within a specific time period. 4.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Collector & Arbitrator, Puri (Opposite Party No.4) to dispose of the above noted case in accordance with law within a period of three months after giving opportunity of hearing to the parties and communicate the result of such exercise to the petitioner.

Accordingly, the writ petition is disposed of. 6.

Urgent certified copy of this order be granted on proper application.
