This matter is taken up through hybrid arrangement (virtual/physical mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

The Writ Petition has been filed by the Petitioner with the following prayer:

"Under the aforesaid facts and circumstances of the case, it is therefore prayed that your Lordship's may gracious and kind enough to issue a rule nisi calling upon the opp. Parties as to why Command Certificate dated 19.06.2022 in respect of Petitioner shall not be quashed if the opp. Parties fail to show cause or show in sufficient cause made the rule absolute;

And further be pleased to quash the Command Certificate and its consequential action;

And further be pleased to pass any other appropriate writ/writs, order/orders and direction/directions as would be deem fit and proper;

And for this act of kindness the Petitioner as in duty bound shall ever pray."

Learned counsel for the Petitioner submits that ventilating his grievance Petitioner has filed a representation before the Superintendent of Police, Jagatsinghpur, Opposite Party No.3, dated 18.06.2022 under Annexure-9, which according to the Petitioner is pending before the Authority for consideration.

Considering the limited nature of grievance and considering the facts and circumstances of the case, this Court directs the Superintendent of Police, Jagatsingpur, Opposite Party No.3, to consider the representation of the Petitioner dated 18.06.2022 (Annexure-9) within a period of four weeks from the date of receipt of certified copy of this order, taking into consideration Annexures-7 and 10, strictly in accordance with law by passing a speaking and reasoned order. Decision so taken be communicated to the Petitioner within a period of two weeks thereafter. Till a decision is taken on the representation of the Petitioner, no coercive action shall be taken against the Petitioner.

6. With the above direction, the Writ Petition stands disposed of.
