This matter is taken up through hybrid mode.

Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party. 3.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 2nd November, 2015 passed by the learned J.M.F.C., Daspalla in G.R. Case No.15 of 2012 wherein N.B.W.(A) has been issued against him.

Since it is a case of the year 2012 wherein N.B.W.(A) has already been issued against the Petitioner in the year 2015 and the Petitioner now coming to this Court seeking quashment

// 2 // of the same, this Court is not inclined to entertain the prayer made by the Petitioner.

Accordingly, the CRLMC stands dismissed.

However, it is open to the Petitioner to surrender before the Court in seisin over the matter within six weeks hence and if he surrenders and moves for bail, the Court in seisin over the matter shall consider and dispose of his bail application on its own merit.
