This matter is taken up through hybrid arrangement (virtual/physical) mode.

This application has been filed for modification of the condition imposed on the Petitioner while granting bail vide order dated 06.09.2022.

Learned Counsel for the Petitioner submits that since release of the Petitioner on bail, he has been abiding by the conditions imposed by him and now because of the reason that the Petitioner is residing with his parents at Umerkote, the condition as to his appearance on very Monday before the IIC, Ampani P.S. is standing too harsh and for that Petitioner is unnecessarily suffering on all fronts. He further submits that the Petitioner is also presently suffering from some serious ailments and is undergoing treatment. In view of all the above, he urges for waiver of said condition. 4.

Learned Counsel for the State opposes the move.

Considering the submissions made and on going through the earlier order dated 06.09.2022 passed in BLAPL No.5856 of 2022, when it is stated that the Petitioner has been abiding by the condition till now and appearing in person before the Trial Court on each date of posting of the case, at this stage, this Court is inclined to waive the imposed condition as to his appearance before the Inspector-in-Charge of Ampani P.S. on every Monday in between 10.00 am to 2.00 pm till conclusion of the trial. 6.

The I.A. is accordingly disposed of.

Issue urgent certified copy as per rules.
