This matter is taken up through hybrid arrangement (virtual/physical mode).

The Petitioner being in custody in connection with Capital P.S. Case No.363 of 2020 corresponding to T.R. Case No.380 of 2020 on the file of learned Additional Sessions Judge-cum-Special Court (POCSO), Bhubaneswar running for commission of offence under sections 363/376(3), I.P.C. & Section 4 of the POCSO Act has filed this application under section 439 of the Cr.P.C. for his release on bail. 3.

Upon hearing learned counsel for the Petitioner and learned counsel for the State and on going through the materials as placed, it is seen that the prayer for grant of bail has been rejected by the Trial Court on 09.06.2021. In view of the lapse of time and subsequent developments in the trial, at this stage the application stands disposed of granting liberty to the Petitioner to renew his prayer before the Trial Court citing all such developments which have taken place in the meantime for their consideration in proper prospective for its disposal in accordance with law.

Issue urgent certified copy as per rules.
