The order vide Annexure-7 though discloses that the Asst. Labour Officer, Bhubaneswar directed the employer of the Petitioner to attend his Office for an inquiry involving complaint at the instance of the Petitioner-workman on 29.02.2020, there is failure of conciliation upon appearance and there is already forwarding of submission of failure report. Petitioner alleges that even after submission of failure report there has been no drawl of I.D. proceeding and the Petitioner is suffering unnecessarily.

Considering the innocuous prayer and as the Industrial Dispute Act clearly provides, upon failure of conciliation adjudication process must start, this Court directs the Assistant Labour Officer to see initiation of an I.D. proceeding forthwith, if the same has not been initiated as yet.
