Heard learned counsel for the Petitioners and learned Addl. Standing Counsel for the State.

The Petitioners are in custody in connection with Parjang P.S. Case No.219 of 2022 corresponding to G.R. Case No.209 of 2022 pending in the court of learned J.M.F.C., Parjang, for the alleged commission of the offence under Sections 399/402 of I.P.C. read with Sections 25 and 27 of the Arms Act and Sections 4/5 of Explosive Substance Act.

It is alleged that the Petitioners and some other persons had gathered and were preparing to commit dacoity in a petrol pump when they were apprehended.

Having regard to the fact that intended offence has not actually been committed as also taking into consideration the period of detention of the Petitioners in custody, I am inclined to allow the prayer for bail.

Let the Petitioners be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that they shall appear before the court below on each date of posting of the case without fail. Further they shall appear before the I.I.C. of Parjang P.S. on every Sunday at 10.00 A.M. for a period of one year months and such fact shall be certified by the IIC to the concerned Court once in a month 7.
The BLAPL is disposed of.
