This matter is taken up through Hybrid Arrangement Order No.
(Virtual/Physical Mode).

Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State.

The Petitioner seeks a direction to the Opp. Party No.1 to sanction and disburse the 3rd RACP benefits of Rs.5400/- w.e.f. 11.12.2014 on completion of 30 years of service as per Annexure-2 and fixation of his pay in Level No.12 of the 7th pay w.e.f. 1.1.2016 with revision and accordingly all arrear may be disbursed to petitioner with revision of pension within a time stipulation as fixed by this Hon'ble Court.

Learned counsel for the Petitioner submits that the Petitioner has filed a representation before the Secretary to Government, Agriculture & Farmers Empowerment Department, Odisha, Opposite Party No.1 on 22.3.2021 and the said representation is pending as of now. Learned counsel for the Petitioner further submits that a direction may be issued to the Opposite Party No.1 to
// 2 // consider and dispose of the representation of the Petitioner which is pending under Annexure-3 within a stipulated time. 5.
Learned Additional Standing Counsel for State on the other hand submits that he has no objection if a direction is given to the Opposite Party No.1 to consider and dispose of the representation of the Petitioner within a stipulated time.

Considering the submissions of the learned counsel for both the parties, this Court disposes of the writ application with a direction to the Opposite Party No.1 to consider and dispose of the representation of the Petitioner within a period of two months from the date of production of certified copy of this order. The Opposite Party No.1 shall consider the representation of the Petitioner strictly in accordance with law taking into account Annexures-4 and 5 and dispose of the same by passing a reasoned and speaking order. The decision so taken on the representation of the Petitioner be communicated to the Petitioner within two weeks thereafter. 7.
With the aforesaid observation, the writ application is disposed of.

Issue urgent certified copy as per rules.
