This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with Special 2(b) C.C. Case No. 13 of 2021 arising out of Sonepur Excise Station P.R. No. 33 of 2021-22, pending on the file of the learned Special-cum-Sessions Judge, Sonepur for the alleged commission of offence under Sections-20(b)(ii)(C) of NDPS Act. 3.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Special-cum-Sessions Judge, Sonepur by Order dtd. 21.03.2022 in Special 2(b) C.C. Case No. 13 of 2021, the present BLAPL has been filed. 4.

Heard learned counsel for the petitioner and learned Counsel for the State.

Taking into account the order passed by this Court dtd. 18.05.2022 in respect of the co-accused in BLAPL No. 3783 of 2022 and keeping in view the quantity of contraband seized being 22 Kgs, this Court directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter, so as to ensure his presence on each date of trial.
