This matter is taken up through hybrid mode.

This writ petition has been filed assailing the order dated 17th June, 2022 (Annexure-7 series) passed by the Executive Engineer (Electrical), TPCODL directing the Petitioner to pay the differential amount within fifteen days.

When the matter was listed on 2nd August, 2022, Mr. Ray, learned counsel for the TPCODL submitted that the Ombudsman, Odisha Electricity Regulatory Commission has already passed the final order on 29th July, 2022 in Consumer Representation Case No.OM (I)-44 of 2020. In view of the above, he submitted that the matter has become infructuous. Learned counsel for the Petitioner prayed for an adjournment to take instruction on the same.

Mr. Rajguru, learned counsel for the Petitioner submits that, in fact, the Ombudsman has already passed the final order in the subject matter of dispute involved in this writ petition. However, he submits that the claim of the Petitioner has been partly allowed by the Ombudsman and the Petitioner is

// 2 // contemplating to challenge the same in appropriate forum. He, therefore, prays for interim protection till the Petitioner moves appropriate forum for an interim order.

Since the Ombudsman has already passed the final order, nothing remains to be adjudicated in this writ petition. 6.

Accordingly, the writ petition is dismissed as infructuous. Urgent certified copy of this order be granted on proper application.
