This matter is taken up through Hybrid Mode.

The petitioners are accused in connection with G.R. Case No. 78 of 2022 arising out of Dunguripali P.S. Case No. 115 of 2022, pending on the file of the learned J.M.F.C., S. Rampur for the alleged commission of offence under Sections-379/34 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge, Sonepur by Order dtd. 20.06.2022 in BLAPL No. 152/52 of 2022, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Counsel for the State.

Taking into account, the criminal proclivity of the petitioner Nos. 3 to 5, this Court is not inclined to entertain this bail application of the said accused persons at this stage. 6.
It shall be open to the petitioners no.3 to 5 to renew their prayer after submission of the Final Form.

Taking into account the nature of allegation relating to Petitioner Nos. 1 & 2, this Court directs the petitioners 1 & 2 to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter, with the additional stipulation that the petitioners shall appear before the jurisdictional Police Station once every fortnight till conclusion of the trial, first date of such appearance to be fixed by the learned Court in seisin over the matter. Any violation of the conditions shall entail cancellation of the bail application. 8.
The Bail Application thus stands disposed of. 9.
