ORDER
Order No.
05.08.2022 2.
1.
This matter is taken up through Hybrid mode.
2.
None appears for the Petitioner at the time of all. 3.
This CMP has been filed assailing order dated 7th February, 2022 (Annexure-4) passed by learned Civil Judge (Junior Division), Baripada in CS No.51 of 2018, whereby an application under Order XXVI Rule 9 CPC filed by the Plaintiff/Petitioner has been rejected.
4.
On the last occasion, i.e., on 15th July, 2022, learned counsel for the Petitioner prayed for an adjournment to remove the defects pointed out by SR. It appears that the defects as pointed out have not been removed.
5.
Since none appears to pursue the matter today, the CMP is dismissed for non-prosecution.
