1. This matter is taken up through hybrid arrangement.

2. Heard.

3. The petitioner who is working as an Assistant Teacher (Jr. S.E.S.) in Biswambar Bidyapitha, Puri, in the district of Puri has filed this Writ Petition challenging legality of the order of his suspension dated 21.05.2022 from service passed by the opposite party No.3- District Education Officer, Puri pending drawal of proceeding against him.

4. Learned counsel for the petitioner submits that when any disciplinary proceeding is neither contemplated nor pending against the petitioner, the order placing him under suspension is erroneous. He further submits that

// 2 // for proceeding against the petitioner, suspension is not at all required.

5. In that view of the matter, the opposite party No.3District Education Officer, Puri is directed to complete the proceeding against the petitioner within a period of six months from the date of submission/ presentation of a certified copy of this order along with a copy of this Writ Petition.

6.Accordingly, this Writ Petition is disposed of.

7. Urgent certified copy of this order be granted on proper application.
