Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with G.R. Case No.151 of 2022 arising out of Balugaon P.S. Case No. 74 of 2022 on the file of learned JMFC, Chilika, registered for the alleged commission of offence under Sections 452/294/323/324/307/506/34 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Asst. Sessions Judge, Banpur by order dated 22.06.2022, the present BLAPL has been filed 5.

Taking into account the order passed by this Court dtd. 14.7.2022 in BLAPL No. 4837 of 2022 and considering the specific allegation of assault being made against the co-accused who has been released on bail by this Court in the aforementioned case, this Court directs that the petitioner shall be released on bail on such terms to be

fixed by the learned court in seisin over the matter so as to ensure the presence of the petitioner in the trial.

Accordingly, the BLAPL stands disposed of.
