Since the petitioner claims for refund of the proportionate auction price for the period from 01.04.2014 to 14.11.2014 as well as security deposit of Rs.1,70,000/- in respect of sand sairat source in River Luna at Kulasukarpara in the district of Cuttack under Sariat Case No. 1 of 2014-15, it is open to the petitioner to pursue his pursue his remedy before the appropriate forum in terms of the DTCN/agreement, which is applicable to him.

With the aforesaid observation, the writ petition stands disposed of.
