This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with G.R. Case No.401 of 2022 arising out of Begunia P.S. Case No. 64 of 2022 on the file of learned SDJM, Khurdha, registered for the alleged commission of offence under Sections 498-A/302/506/34 of the I.P.C. and Sec.4 of the D.P.Act.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Additional Sessions Judge, Khurdha by order dated 27.05.2022, the present BLAPL has been filed. 5.

On perusal of the order of rejection, it is seen that petitioner had moved the learned court below at the stage of investigation. In the meanwhile it is stated at the bar that the investigation has been completed and Charge Sheet has been filed, inter alia, under Section

306 of the I.P.C. though the F.I.R. was registered under Section 302 of the I.P.C.

Taking into account such submission while not entertaining this bail application, this Court directs the petitioner to move the learned court in seisin over the matter and renew his prayer. 8.

Accordingly, the BLAPL stands disposed of.
