This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with G.R. Case No. 137 of 2021 corresponding to Jatni P.S. Case No. 126 of 2021, pending on the file of the learned J.M.F.C., Jatani, for the alleged commission of offence under Sections457/395 of the I.P.C and he is in custody since 15.04.2021. 3.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions Judge-cum-Special Judge, CBI-II, Bhubaneswar by Order dtd. 16.04.2021 in B.A. No. 626 of 2021, the present BLAPL has been filed.

Heard Mr. A.K. Jena, learned counsel for the petitioner and Mr. K.K. Gaya, learned Additional Standing Counsel for the State.

Taking into account the materials on record, and the antecedents of the petitioner, this Court is not inclined to exercise jurisdiction under Section-439 Cr.P.C. The Bail Application accordingly stands rejected.

It shall be open for the petitioner to move this Court at a later stage.

Urgent certified copy of this order be granted as per rule.
