This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner.

This is an application under Section 439 of the Code of Criminal Procedure filed by the Petitioner for bail in connection with Baliguda P.S.Case No.127 of 2021, corresponding to C.T.No.43 of 2021, pending in the Court of the learned Special Judge-cum-A.D.J., Balliguda for alleged commission of offence under Sections 20(b)(ii)(C) of N.D.P.S.Act.

Learned counsel for the Petitioner does not want to press this bail application with a liberty to move a fresh application in the event the trial is not concluded within a stipulated period of time. 5.
Considering the aforesaid submissions, while disposing of the bail application of the Petitioner as withdrawn, this Court directs the trial court to expedite trial and conclude the same within a period of four months from the date of production of certified copy of this order. In the event trial is not concluded within the aforesaid period,
// 2 // it is open for the Petitioner to move an application for bail and in the event such a bail application is filed the same shall be considered without being influenced by any other facts.
