This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Learned counsel for the petitioner by filing the photocopy of the surrender certificate submits that the original copy of the surrender certificate has already been filed in Court but not available on record. Office is requested to verify and place it on record. 3.
This is an application U/S. 439 of Cr.P.C. by the Petitioner for grant of bail in connection with Dargha Bazar P.S. Case No.51 of 2022 corresponding to G.R.Case No.634 of 2022 pending in the Court of learned S.D.J.M.(S), Cuttack for commission of offence punishable U/S. 392 of the I.P.C.

In the course of hearing of the bail application, learned counsel for the petitioner prays to dispose of the bail application with liberty to the petitioner to renew his prayer for bail after examination of the victim but he further submits that despite issuance of summons, the victim is not turning up in the Court to give her evidence. 5.
In view of the aforesaid submissions and prayer, this Court without adverting to the materials on merit disposes of the BLAPL with liberty to the petitioner to renew his prayer for bail after examination of the victim and the learned trial Court is requested to take sincere step for examination

Accordingly, the BLAPL stands disposed of.
