This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with Kantabanji P.S. Case No. 299 of 2019 corresponding to S.T. Case No.17 of 2020 pending in the Court of learned Addl. Sessions Judge, Kantabanji for offence punishable under section 302 of the Indian Penal Code.

Perused the evidence of the eye witnesses so also the status report dated 20.09.2022 furnished by the learned trial Court.

Learned counsel for the petitioner submitted that the petitioner is in judicial custody since

// 2 // 16.12.2019 In view of the available material on record and the nature and gravity of the accusation against the petitioner so far as per the status report furnished by the learned trial Court, while not inclining to release the petitioner on bail, the learned trial Court is directed to conclude the trial by the end of December 2022. The petitioner is at liberty to renew the prayer for bail if the trial is not concluded within the aforesaid period.

With the aforesaid observation, the BLAPL stands disposed of.
