This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with C.T. Case No. 176 of 2022 arising out of Kesinga P.S. Case No. 183 of 2022, pending on the file of the learned J.M.F.C., Kesinga for the alleged commission of offence under Sections-399/402 of the I.P.C read with Section 25(1)/27 of Arms Act. 3.
Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Kalahandi, Bhawanipatna by Order dtd. 24.05.2022 in BLAPL No. 167 of 2022, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Counsel for the State.

Taking into account the nature of allegation and release of the accused by the Order dtd. 22.06.2022 in BLAPL No. 5265 of 2022 and release of one co-accused- Gajendra Kumar in BLAPL No. 5098 of 2022, this Court directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter.

Taking into account, the character and antecedents of the petitioner, it is directed that while releasing on bail the learned Court in seisin of the matter shall stipulate that he shall appear before he jurisdiction police station once in a every week till conclusion of trial.

The Bail Application thus stands disposed of. 8.
