This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 363, 379, I.P.C.

Considering the nature of allegation, gravity of the offence and the facts of the case, though I am not inclined to grant anticipatory bail to the Petitioner, however it is observed that, in the event the Petitioner surrenders before the learned J.M.F.C., Chandikhol in C.T. Case No.1248 of 2020 corresponding to Dharmasala P.S. Case No.372 of 2020 within a period of three weeks from today, the Petitioner shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper, but subject to verification of the age of the victim girl that she is 18 years
// 2 // old and further subject to verification that the Petitioner and the victim are married and staying together. If required, a joint affidavit to that effect shall also be filed by the Petitioner and the Victim girl before the learned court in seisin over the matter. 5.
The ABLAPL is disposed of accordingly.
