Heard learned counsel for the parties.

Considering the allegation of non-compliance of natural justice before issuing Annexure-2 and without wasting of any further time by issuing notice and examining the case here, this Court disposes of the Writ Petition, permitting the Petitioner to have his objection by submitting the same before the Executive Officer, Notified Area Council, Daspalla- Opposite Party No.3 at least within a period of seven days hence. On the submission of objection by the Petitioner within the same period, same shall be taken into consideration considering it to be a response as against Annexure-2 and decision, as appropriate, shall also be taken within a period of five weeks thereafter. In the event the order at Annexure-2 has not been given effect to, the same shall remain stayed for six weeks. (Biswanath Rath) Judge Swarna/ Ayesha
