This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The Petitioners are accused in connection with G.R. Case No.341 of 2021 arising out of Nuagaon P.S. Case No. 78 of 2021 on the file of learned S.D.J.M., Nayagarh, registered for the alleged commission of offence under Sections 274/275/34 IPC. The petitioners are in custody since 4.

Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the learned Additional Sessions Judge, Nayagarh by order dated 25.06.2021, the present BLAPL has been filed.

The learned counsel for the State while opposing prayer for grant of bail has not been able to produce the chemical examination report.

Taking into account that the charge sheet has already been filed, period of detention and nature of allegation vis-a-vis role played by the petitioners, this Court directs that the petitioners shall be released on bail on such terms to be fixed by the court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
