Heard learned counsel for the Parties.

Considering the innocuous prayer, seeking a direction for considering the representation at Annexure-3, on the allegation of the Petitioner that not only there is public expenditure on private land but also allegation involving public authority is encroaching upon the private land, in the matter of digging of a bore well that too without consent of the Petitioner, it appears that Petitioner has a pending application at Annexure-3 before the Collector, Nayagarh- Opposite Party No.1.

In disposal of the Writ Petition, this Court directs the Opposite Party No.1 to consider the representation at Annexure-3 and take decision at least within a period of ten days hence with service of copy of this order along with copy of the Writ Petition. (Biswanath Rath) Judge Swarna/ Ayesha
