This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 22.04.2020 in connection with Padwa P.S. Case No.38 of 2021 corresponding to T.R. Case No.43 of 2022 pending in the Court of learned Addl. Sessions Judge-cum-Special Judge, Koraput for the alleged commission of offence under Sections 20(b)(ii)(B) of NDPS Act.

The petitioner and some other persons were transporting contraband ganja weighing 7 Kg 920 grams when they were apprehended by police.

Considering the fact that the seized contraband is less than commercial quantity as also the fact that the co-accused, namely, M. Bijaya has already been released on bail as per order passed by this court in BLAPL No.6961 of 2022, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall furnish cash security of
Rs.75,00,00/- (Rupees Seventy Five Thousand). Further he shall appear before the trial court below on each date of posting of the case without fail.

BLAPL is disposed of accordingly.
