Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with C.T. Case No.60 of 2022 arising out of Bhawanipatna Sadar P.S. Case No. 17 of 2022 on the file of learned SDJM, Bhawanipatna, registered for the alleged commission of offence under Sections 498-A/306 of the I.P.C. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Sessions Judge, Kalahandi, Bhawanipatna, by order dated 20.06.2022, the present BLAPL has been filed. The petitioner is stated to be in custody since 17.01.2022. 5.

It is revealed from the Final Form on record that "finding the loneliness in the house, deceased committed suicide by means of one green checkered towel on the roof of the house." It is also stated in the Charge Sheet that the petitioner was not present at the relevant point of time when the incident took place.

Taking into account the period of custody and the recitals in the Case Diary, vis-à-vis accusation relating to the petitioner, this Court directs the petitioner shall be released on bail on such terms to be fixed by the learned court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
