CORAM:
JUSTICE SASHIKANTA MISHRA ORDER_ 15.09.2022 1.
This matter is taken up through hybrid mode.
Order No.
02.
2.
Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.
3.
The petitioner is in custody since 25.05.2022 in connection with Jashipur P.S. Case No. 120 of 2022 corresponding to C.T. Case No 114 of 2022 pending in the court of learned J.M.F.C., Jashipur for the alleged commission of offence under Sections 341/323/294/307/395/120-B of IPC. 4.
It is alleged that the petitioner was a part of the group of around thirty persons who assaulted the informant and his group members and fired from their guns causing serious injuries on them.
5.
Considering the fact that nothing further remains to be done so far as the investigation is concerned, I find no justified reason to detain the petitioner in custody any longer. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to
impose including the following conditions:- i. He shall appear before the court in seisin over the matter personally on each date of posting of the case and in case of even a single default necessary order shall be passed to take him into custody again.
ii. He shall appear before the IIC of Baruam police station on every alternate Sunday at 10.00 A.M. till conclusion of trial and such fact shall be certified by the IIC to concerned court once in a month
5. The BLAPL is accordingly disposed of.
6.
Urgent certified copy of this order be granted on proper application.
