1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

3. The petitioner is in custody since 19.05.2022 in connection with Binjharpur P.S. Case No.147 of 2022 corresponding to C.T. Case No.451/ 2022 pending in the Court of learned S.D.J.M., Jajpur for the alleged commission of offence under Sections 452/427/323/324/ 326/307/354/506/34 of IPC.

4. It is alleged that the petitioner in association with other persons entered into the house of the informant at night and assaulted her husband by means of sword, bhujali and other weapons. The injured was admitted to hospital and has since been discharged. Some of the co-accused persons have been released on bail as per order passed by this Court in ABLAPL No. 2309 of 2022. The petitioner stands on the same footing more or less as the said coaccused persons.

5. Taking into consideration all the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may

deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. Further he shall appear before the IIC, Binjharpur Police Station on every Sunday at 10 a.m. till conclusion of trial and such fact shall be certified by the IIC to the concerned court once in a month.

6. BLAPL is accordingly disposed of.

7. Issue urgent certified copy as per rules.
