This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

The Petitioners are accused in connection with G.R. Case No. 298 of 2022 arising out of Nayagarh P.S. Case No. 65 of 2022 on the file of learned SDJM, Nayagarh, registered for the alleged commission of offence under Sections 364(A)/347/323/294/506/307/34 of the I.P.C. and Sections 25/27 of the Arms Act.

Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the learned Addl. Sessions Judge, Nayagarh, by order dated 21.06.2022, the present BLAPL has been filed.

It is submitted by learned counsel for the State that the investigation is going on.

This Court is not inclined to entertain this application at this stage. The BLAPL is dismissed giving liberty to the petitioners to move the learned court below after filing of Charge Sheet. On such application, being moved, the learned court shall dispose of the same without being influenced by the earlier order or by the present order.
