This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with G.R. Case No. 21 of 2022 arising out of Bandamunda Case No. 59 of 2022 on the file of learned 1st Addl. Sessions Judge-cum-Special Judge, Rourkela registered for the alleged commission of offence under Sections 20(b)(ii)(c) of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. Sessions Judge-cum-Special Judge, Rourkela, by order dated 17.05.2022, the present BLAPL has been filed. The petitioner is stated to be in custody since 7.04.2022. 5.

Learned counsel for the State opposes the grant of bail, inter alia, on the ground of bar under Sec. 37 of the NDPS Act. 6.

Taking into account the quantity of contraband seized and period of custody, this Court directs that the petitioner shall be released

on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
