This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with G.R. Case No.1287 of 2020 arising out of Berhampur Town P.S. Case No. 144 of 2020 on the file of learned JMFC, Berhampupr, registered for the alleged commission of offence under Sections 379/420/34 of the I.P.C. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned 1st Additional Sessions Judge, Berhampur, by order dated 19.04.2021, the present BLAPL has been filed. The petitioner is stated to be in custody since 22.09.2020. 5.

Learned counsel for the State brings to the notice of the Court that the petitioner has criminal proclivity and opposes the prayer for bail.

Considering the nature of allegations and period of custody, this Court directs that the petitioner shall be released on bail. The terms shall be fixed by the learned court in seisin over the matter. 7.

Additionally, it is directed that the petitioner shall appear before the jurisdictional Police Station once in every seven days. The first date of appearance shall be fixed by the learned court in seisin over the matter.

Violation of condition of such appearance shall entail cancellation of bail by the learned court in seisin over the matter after following the due process of law without any further reference to this Court.

Accordingly, the BLAPL stands disposed of.
