This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Spl. G.R. Case No.138 of 2022, on the files of learned District Judge-cum-Special Judge, Balasore, arising out of Jaleswar P.S. Case No.214 of 2022, under Sections 21(b)/29 of the NDPS Act and is in custody since 09.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned District Judge-cum-Special Judge, Balasore by order dated 21.06.2022 in the aforementioned case, the present BLAPL has been filed.

Since the investigation is in progress, this Court is not inclined to entertain this application at this stage. 6.

Leave is granted to the petitioner to move the learned Special Judge after submission of final form. 7.

The learned Special Judge is called upon to consider such application if moved on its own merits without influenced by the earlier rejection or the order passed by this Court. 8.

Accordingly, the BLAPL stands disposed of.
