Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 15.03.2021 in connection with Bolangir Sadar P.S. Case No.231 of 2012 corresponding to Sessions Case No. 24 of 2021 pending in the Court of learned District and Sessions Judge, Bolangir for the alleged commission of offence under Section 302/34 of IPC.

The case record reveals that the dispute between the two groups arose out of a petty issue i.e., grazing of cows. In course of such quarrel, the petitioner and two other persons are said to have assaulted the deceased, causing fatal injuries. There is however, no direct material to show the complicity of the petitioner in the occurrence.

Having regard to the above facts as also the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
