This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

Learned counsel for the Petitioner submits that the Petitioner is Forester at Gopalpur Forest Range. It is further submitted by the learned counsel for the Petitioner that the Petitioner is no way involved in the present crime. He further submits that the Petitioner has only one antecedent of similar nature.

Considering the fact that the Petitioner is a Government employee and there is no chance of his absconding and having one criminal antecedent and bar under Section 51 A of Odisha Wildlife (Protection) Act 1972 , this Court is not inclined to grant anticipatory

// 2 // bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned J.M.F.C., Badamba in 2(b) C.C.Case No.05 of 2022 arising out of Badamba Range OR Case No.14 of 2022-23 within a period of three weeks from today and moves for bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate. While fixing condition, learned court below shall impose condition that the Petitioner shall furnish an undertaking that he shall not involve in similar nature of case.
