This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.126 of 2021, on the files of learned J.M.F.C., Narasinghpur, arising out of Kanpur P.S. Case No.53 of 2021, under Sections 376 of IPC and is in custody since 23.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Athagarh, by order dated 23.06.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account that the charge sheet has already been filed and statement of the victim and the period of custody, this

Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin of the matter 6.

Accordingly, the BLAPL stands disposed of.
