This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.443 of 2020, on the files of learned S.D.J.M., Birmaharajpur, arising out of Ulunda P.S. Case No.136 of 2020, under Sections 302/201/34 of IPC and is in custody since 11.02.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sonepur, by order dated 05.04.2021 in the aforementioned case, the present BLAPL has been filed.

Taking into account the genesis of the offence and considering the age of the petitioner i.e. 70 years, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin of the matter.

Accordingly, the BLAPL stands disposed of.
