Heard Mr. B.S. Rayaguru, learned counsel for the petitioner and Mr. D. Nayak, learned Additional Government Advocate.

According to Mr. Rayaguru, the petitioner is a registered Vendor with regard to supply of materials for execution of various projects under Mahatma Gandhi National Rural Employment Guarantee Act. His grievance is that though pursuant to the various work orders issued with regard to execution of MGNREGS work for Baunsabati Grama Panchayat of Bhapur Block in the district of Nayagarh, he has supplied various materials however, till date his payments have not been made. Though highlighting his grievances, the petitioner has approached the Project Director, D.R.D.A, Nayagarh (opposite party No.4) on 05.04.2022 under Annexure-4, however, during course of hearing, Mr. Rayaguru submits that liberty may be granted to the petitioner to approach the Block Development Officer, Bhapur Block (opposite party No.5), who according to
// 2 // him is the appropriate authority to release the funds. In this connection Mr. Rayaguru relies upon letter No.2102 dated 12.07.2022 issued by the Chief Development Officer-cumExecutive Officer, Zilla Parisad, Nayagarh to opposite party No.5 under Annexure-8.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a representation before the Block Development Officer, Bhapur Block (opposite party No.5) through registered post within a period of two weeks from today. In the event, such representation is filed along with a copy of this order, the opposite party No.5 is directed to take a decision on the same in accordance with law within a period of two weeks from the date of receipt of such representation and communicate the result of such exercise to the petitioner. 4.
Accordingly, this writ petition is disposed of. 5.
Urgent certified copy of this order be granted on proper application.
