This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with Special NDPS Case No. 23 of 2022 arising out of Kantamal P.S. Case No. 81 of 2022 on the file of learned Addl. District & Sessions Judge-cum-Special Judge, Kantamal registered for the alleged commission of offence under Sections 20(b)(ii)(B) of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. District & Sessions Judge,Kantamal, by order dated 24.06.2022, the present BLAPL has been filed.

Taking into account the quantity of contraband seized is less than the commercial quantity and the petitioner being a local and considering the period of custody, this Court directs the petitioner shall
be released on bail. The terms to be fixed by the learned court in seisin over the matter.

Additionally, it is directed that the petitioner shall appear before the jurisdictional Police Station once every week till submission of the Final Form.

Accordingly, the BLAPL stands disposed of.
