This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and the learned Standing Counsel for Vigilance department. Perused the records. 3.
This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

Learned counsel for the Petitioner submits that the Petitioner, who is innocent has no nexus with the alleged crime. The present case has been lodged with an evil intention only in order to harass the Petitioner.

On the other hand, on instruction learned Standing Counsel for Vigilance department submits that the personal interrogation of the Petitioner is not required.

Considering the nature of allegations made, gravity of the offence and the fact of the case, I am not inclined to grant
// 2 // anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned Special Judge, Vigilance, Berhampur in G.R.Case No.06 of 2022 (V) arising out of Berhampur Vigilance P.S.Case No.09 of 2022 within a period of three weeks from today and moves for bail, she shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate.

The ABLAPL is accordingly disposed of.
