This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State.

The present writ application has been filed by the Petitioner with the following prayer:

"It is, therefore, prayed that Your Lordships may be pleased to direct the State/O.Ps to rectify/modify the wrong pay fixation in respect of the Petitioner vide Annexure-4 and direct to correctly fix up the pay of the Petitioner on the basis of Grade Pay Rs.5400/- on completion of 30 years of service under 3rd MACP in Cell-4 of Level-12 of pay matrix at Rs.61,300/- w.e.f. 19.10.2016 and disburse the consequential financial benefits to the Petitioner.

And pass any other order/orders as deemed fit and proper in the ends of justice, equity and good conscience." 4.

In course of hearing, learned counsel for the Petitioner submits that ventilating his grievance, the Petitioner has filed a detailed representation before the Director of Health Services, Odisha, Opposite Party No.4 under Annexure-5 on 18.05.2022. It is

// 2 // also submitted by the learned counsel for the Petitioner that the said representation is pending without consideration as of now. He also submits that a direction may be issued to the Opposite Party No.4 to consider the representation of the Petitioner within a stipulated period of time.

Learned Additional Standing Counsel on the other hand submits that he has no objection if the representation of the Petitioner is considered by the Opposite Party No.4, which is stated to be pending, within a stipulated period of time in accordance with law. 6.

Considering the limited nature of grievance of the Petitioner, the writ application is disposed of at the stage of admission with a direction to the Opposite Party no.4 to consider the representation of the Petitioner under Annexure-5 in accordance with law within a period of two months from the date of production of certified copy of this order. The Opposite Party No.4 shall do well to dispose of the representation of the Petitioner by passing a speaking and reasoned order. The decision so taken on the representation of the Petitioner, shall be communicated to the Petitioner within a period of two weeks thereafter.

With the aforesaid observation, the writ application stands disposed of.

Issue urgent certified copy as per Rules.
