This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The Petitioners are accused in connection with G.R. Case No.1062 of 2022 arising out of Badabazar P.S. Case No. 114 of 2022 on the file of learned SDJM, Berhampur, for the alleged commission of offence under Sections 272/273/420/34 of the I.P.C., Sec. 20 of Cigarettes and other Tobacco Products Act and Sections 51/52/53/56/57/59/63 of the Food Safety & Standards Act.

Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the learned 3rd Addl. Sessions Judge, Berhampur by order dated 24.06.2022, the present BLAPL has been filed. The petitioner is stated to be in custody since 23.05.2022.

Taking into account the nature of allegation and period of custody, it is directed that the petitioners shall be released on bail on such terms to be fixed by the learned court in seisin over the matter including that the petitioner No.2-Rantu Kumar Sahu @ Rintu shall appear before the jurisdictional Police Station once in every week till conclusion of the trial. It is needless to say that violation of any of the conditions shall entail cancellation of the bail.

Accordingly, the BLAPL stands disposed of.
