This matter is taken up through Hybrid Mode.

Learned counsel for the petitioner is permitted to correct the description of the petitioner in Court.

Heard learned counsel for the petitioners and learned counsel for the State.

The Petitioner is an accused in connection with G.R. Case No. 574 of 2022 arising out of Paradeep P.S. Case No. 178 of 2022 pending on the file of learned J.M.F.C. (P), Kujanga registered for the alleged commission of offence under Sections457/380/34 of the I.P.C. 5.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. Dist. Sessions Judge,

Kujang by order dated 23.06.2022 in BLAPL No. 277 of 2022, the present BLAPL has been filed.

Taking into account the submission of the learned counsel for the petitioner that the stolen articles have already been recovered. Keeping in view the punishment prescribed, this Court directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter. Additionally it is directed that the petitioner shall appear before the Investigating Officer once every week till the conclusion of the investigation. Such certification shall be sent to the Court in seisin over the matter.

The first date and time of such appearance to be fixed by the learned Court below.

It is needless to say, violation of any conditions shall entail cancellation of this order.

Accordingly, the BLAPL stands disposed of.

10.

Urgent certified copy of this order be granted as per rules.
