Heard learned counsel for the petitioner and learned counsel for the State.

In fact, the petitioner filed an application under Section 91 Cr.P.C. before the learned J.M.F.C. Nimapara in G.R. Case No.258 of 1999 for calling of the record in G.R. Case No.311 of 1995 for proper adjudication of the matter, which was rejected. Learned counsel for the petitioner submits that without any basis, the aforesaid application has been rejected as because certain aspect has to be stated before the court with regard to compromise. However, the Court is of the view that petitioner can very well produce the certified copy of the relevant documents before the court below and therefore, no need lies for calling of the entire record in G.R. Case No.311 of 1995.

In view of the above, the CRLMC stands disposed of with liberty granted to the petitioner to cause production of the certified
copies of the relevant documents of the concerned GR record before the learned court below.
